Upon graduation I worked as the public defender for the Travis County Juvenile Court until I entered private practice.

If you or someone in your family is injured in an accident, and you believe that a damage claim is appropriate, you should be aware of certain issues. First, in order to make a claim against another party, you must be able to prove that the other party was responsible for the injury. This involves proving that the allegedly responsible party, be it an individual, business or governmental entity, was as fault. This is done by proving negligence. To prove negligence one must first show that the other entity had a duty to the victim, and that this entity failed in meeting that duty. In many jurisdictions, average awards have decreased by as much as 75% over the past 10 years, and of course, insurance company offers have followed this trend. Therefore, it is extremely important that your damage claim be gathered and presented in a professional and knowledgeable manner. You can be assured your claim will be reviewed by the insurance company in a way that attempts to minimize your damages. Again, as with the presentation of your negligence argument, it is critical that you have competent legal advice when presenting your claim for damages.
